Virginia Senate Leader Louise Lucas Indicted in Federal RICO Case

Virginia state Sen. L. Louise Lucas, the president pro tempore of the Virginia Senate and one of the most powerful Democrats in the state, has been charged in a federal racketeering case, the Justice Department said Thursday. Lucas, 82, surrendered to authorities Thursday morning, according to a Justice Department spokesperson cited by CBS News and NBC News.

Attorney General Todd Blanche announced the case at a press conference in Norfolk, saying in remarks posted to X by the White House’s Rapid Response account that seven people were “arrested or surrendered for allegedly participating in a large-scale RICO drug trafficking and money laundering conspiracy.” Blanche said Lucas was indicted on five counts: racketeering conspiracy, conspiracy to distribute and possess with intent to distribute marijuana, conspiracy to launder money, conspiracy to commit honest services fraud, and maintaining a drug-involved premises.

What the indictment alleges

According to CBS News, the 45-page indictment was filed in the Eastern District of Virginia and charges Lucas alongside six co-defendants, including members of her own family. CBS News reported that prosecutors allege the group distributed large quantities of illegal marijuana under the cover of a legal medical cannabis business, and that Lucas faces five of the eight charges in the indictment.

Prosecutors allege that since at least 2019 Lucas led the scheme and used her political influence to enact legislation and regulations that benefited herself and her co-defendants, while shielding the operation from state law enforcement, CBS News reported. CBS News also reported that the indictment says Lucas directed the enterprise to buy and sell more than 100 kilograms of illegal marijuana.

NBC News reported that the indictment cites an intercepted February 2026 phone call in which Lucas allegedly told an unindicted co-conspirator it was their “last chance at generational wealth,” adding, “I’ve gotten too old to not be greedy.” CBS News reported that in a March call with a Virginia lawmaker, Lucas allegedly said she needed the recreational marijuana industry to begin because “when I did it, it was obviously illegal.”

Blanche and Patel respond

“Whether you are a Democrat or Republican, an elected official or an everyday citizen, nobody is above the law,” Blanche said, according to video posted by Fox News. In a statement quoted by CBS News, Blanche said the charges “reveal the behavior of a public servant who will put her own financial interests before the people she was elected to serve.”

FBI Director Kash Patel called the case “truly the epitome of hypocrisy for a public official,” according to Fox News, which reported that Patel said Lucas used her position of power and public trust to shield an alleged criminal enterprise.

Background

The charges come nearly six months after federal agents searched Lucas’s office and The Cannabis Outlet, a Portsmouth shop she co-owns, CBS News reported. A source told CBS News at the time that the investigation began during the Biden administration, and NBC News has also reported that the probe predates the Trump administration.

Lucas, a vocal critic of President Trump, played a central role in Virginia Democrats’ push for a new congressional map that would have added four Democratic-leaning seats, according to CBS News. That map was struck down by the Virginia Supreme Court in May, and the U.S. Supreme Court declined to revive it, CBS News reported.

NBC News noted that the charges come 12 days before the midterm elections, and that Lucas is not on the ballot this year. Rep. Suhas Subramanyam, a Virginia Democrat, accused the Justice Department of carrying out vendettas against the president’s political opponents, NBC News reported. NBC News said it had reached out to Lucas’s office and her legal counsel for comment. The charges are allegations, and Lucas is presumed innocent unless proven guilty in court.
