Welcome to Daily Beltway. These Terms of Service (“Terms”) govern your access to and use of the Daily Beltway website at dailybeltway.com, our subdomains and storefronts, our email newsletters and alerts, and the official Daily Beltway accounts, channels and feeds we operate on third-party platforms (together, the “Services”).
By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. Who We Are
Daily Beltway is an independent news and commentary publisher covering politics and national affairs. In these Terms, “Daily Beltway,” “we,” “us,” and “our” refer to Daily Beltway and its operators. You can reach us at tom@dailybeltway.com.
2. Eligibility
The Services are intended for a general adult audience. You must be at least 13 years old to use the Services, and at least 18 years old to purchase merchandise, subscribe to a paid offering, or submit content. If you are between 13 and 18, you may use the Services only with the involvement of a parent or legal guardian. By using the Services you represent that you meet these requirements.
3. Editorial Content
Daily Beltway publishes news reporting, analysis, opinion and commentary. Opinion and commentary reflect the views of their authors. We make a good-faith effort to be accurate, and we correct material errors when we learn of them, but the Services are provided for general information only. Nothing on the Services is legal, financial, medical, tax or investment advice, and you should not rely on it as such.
Headlines, summaries and social posts are necessarily condensed. Where a story is developing, facts may change after publication.
4. Acceptable Use
When using the Services, you agree not to:
- Break any applicable law or regulation, or encourage others to do so.
- Post or transmit content that is unlawful, defamatory, harassing, threatening, obscene, or that infringes anyone’s rights.
- Impersonate any person or organization, including Daily Beltway or its staff.
- Attempt to gain unauthorized access to the Services, any accounts, or any connected systems.
- Scrape, crawl, harvest, or bulk-download content except as expressly permitted in writing or allowed by our robots.txt.
- Interfere with or disrupt the Services, including by introducing malware or placing unreasonable load on our infrastructure.
- Resell, redistribute or republish our content in a way that competes with the Services or misrepresents its source.
5. User-Submitted Content
You may be able to submit comments, tips, messages, or other material (“User Content”). You retain ownership of your User Content. By submitting it, you grant Daily Beltway a non-exclusive, worldwide, royalty-free, perpetual and irrevocable license to use, reproduce, adapt, publish, translate and distribute that User Content in connection with the Services and their promotion, in any media now known or later developed.
You represent that you own or otherwise have the right to submit your User Content and that it does not infringe anyone’s rights. We are not obligated to publish, keep, or continue to display any User Content, and we may edit, refuse or remove it at our discretion, with or without notice.
Unsolicited story ideas, tips and submissions are welcome, but sending them does not create a confidential relationship or an obligation to pay you or credit you.
6. Our Intellectual Property
All content on the Services that is not User Content, including articles, video, audio, graphics, thumbnails, logos, page design and compilations, is owned by Daily Beltway or its licensors and is protected by copyright, trademark and other laws.
You may read, share links to, and quote brief excerpts of our content with clear attribution and a link back to the original. You may not copy substantial portions, republish full articles, re-upload our video, or use our name, logo or branding to imply endorsement or affiliation, without our prior written permission.
7. Copyright Complaints
If you believe material on the Services infringes your copyright, send a notice to tom@dailybeltway.com that identifies the copyrighted work, identifies the material you say is infringing and where it is located, gives your contact information, and includes a statement made in good faith that the use is not authorized, together with a statement that the information in your notice is accurate. We will review properly submitted notices and may remove material and terminate repeat infringers.
8. Email, Alerts and Communications
If you subscribe to our newsletters or alerts, you agree to receive recurring emails from us. Every marketing email includes an unsubscribe link, and you can opt out at any time. We may still send you transactional messages relating to an order or an account. Message frequency varies. We do not sell your email address.
9. Merchandise and Orders
Where we offer merchandise, product descriptions, images and prices are provided as accurately as we can manage but are not guaranteed to be error-free. Colors and print placement can vary between production runs and between screens and physical goods.
We may refuse or cancel any order, including after an order confirmation, for reasons including pricing errors, suspected fraud, or stock problems. If we cancel an order you have paid for, we will refund it. Orders are fulfilled by third-party print and shipping partners, and delivery timelines are estimates rather than promises. Returns and refunds are handled under our posted refund and returns policy.
Payment is processed by third-party payment processors. We do not store full payment card numbers.
10. Advertising, Sponsorships and Affiliate Links
The Services carry advertising, sponsored placements and affiliate links, and we may earn a commission when you buy through them. Sponsored and affiliate content is identified where required by law. Advertisements and sponsor claims are the responsibility of the advertiser, and their appearance is not an endorsement by Daily Beltway.
11. Third-Party Platforms and Links
The Services link to and integrate with third-party platforms and services, including social video and social media platforms where we publish official Daily Beltway channels. Your use of those platforms is governed by their own terms and privacy policies, not ours. We do not control and are not responsible for third-party content, availability, moderation decisions, recommendation systems, or the handling of your data by those platforms.
Where we use a platform’s official tools or interfaces to publish and manage our own accounts and content, we do so as the account holder, and we remain responsible for the content we publish. We do not post on your behalf and we do not access your accounts on those platforms.
12. Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.
13. Availability and Changes
We may change, suspend or discontinue any part of the Services at any time, including features, content and availability. We may impose limits on certain features or restrict access without notice or liability. We do not promise that the Services will always be available, uninterrupted, timely, secure or error-free.
14. Disclaimers
THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICES OR THEIR CONTENT WILL BE ACCURATE, COMPLETE, CURRENT, RELIABLE OR UNINTERRUPTED.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DAILY BELTWAY AND ITS OPERATORS, CONTRIBUTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot lawfully be limited.
16. Indemnification
You agree to indemnify and hold harmless Daily Beltway and its operators from any claims, damages, liabilities, losses and expenses, including reasonable legal fees, arising out of your use of the Services, your User Content, or your breach of these Terms or of any law or third-party right.
17. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, including for conduct we believe violates these Terms or is harmful to other users or to us. Sections that by their nature should survive termination will survive, including sections 5, 6, 14, 15, 16 and 18.
18. Governing Law and Disputes
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Will County, Illinois, and you consent to the personal jurisdiction of those courts.
19. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Material changes will be signalled on this page. Your continued use of the Services after changes take effect means you accept the revised Terms.
20. Miscellaneous
These Terms, together with our Privacy Policy and any policy referenced in them, are the entire agreement between you and Daily Beltway regarding the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the business.
