Campaign finance records show the payments began modestly in 2021 with $3,900. The amount skyrocketed to $46,900 in 2022, followed by another $38,900 in 2025. The total of $88,800 raises serious questions about potential violations of federal campaign finance law and immigration employment statutes.

Federal election law explicitly prohibits using campaign funds for personal expenses like household help or childcare services. The fact that these payments appear in public filings has stunned political observers.

“There are campaign finance laws for a reason,” one legal analyst noted.

The brazen nature of the expenditures suggests either gross negligence or deliberate disregard for federal regulations.

The immigration angle compounds Swalwell’s legal exposure. Employing undocumented workers violates federal law, and employers must verify work authorization through Form I-9. Legal experts debate whether liability falls on the employer or employee when immigration status is in question.

“The question will become, is that his violation, or is that the nanny’s violation? And he should have known versus what he knew, right? Because if he’s the employer, you sign off on documents,” one observer explained.

The timing proves particularly embarrassing for Swalwell, who has positioned himself as a California gubernatorial contender while regularly criticizing Republicans on immigration enforcement. Reports indicate he recently suspended his campaign, though federal investigations into the payments may be underway.

The case highlights a familiar pattern among Democratic politicians who demand strict immigration enforcement against American businesses while allegedly flouting the same laws themselves. Swalwell has been a vocal critic of border security policies, making his alleged employment of an undocumented worker particularly hypocritical.
