Feds Send Arizona Noncitizen Voter Registration Claims to FBI

Federal prosecutors in Arizona have opened a case into reports that three left-leaning nonprofit groups helped register noncitizens to vote, and they have handed the matter to the FBI just days before Tuesday’s midterm election. U.S. Attorney Timothy Courchaine announced the move Friday night in a statement posted by the U.S. Attorney’s Office for the District of Arizona on X.

The office said it “has opened a case into recent reporting about three non-profit organizations registering non-citizens to vote in Arizona” and “has already referred the matter to the FBI for a thorough federal investigation,” according to the statement. The groups named are Stand Indivisible Arizona, Worker Power and When We Count, according to Just The News and AZFamily.

Letters to Election Officials

Courchaine also sent letters on Oct. 26 to Maricopa County Recorder Justin Heap and Arizona Secretary of State Adrian Fontes, according to his office’s statement. In those letters, Courchaine wrote that “based on written and video reports,” personnel acting on behalf of the three organizations “either intentionally disregarded or were recklessly ignorant of Arizona’s law prohibiting the registration of non-citizens in elections,” AZFamily reported.

“Based on a cursory review, it appears these organizations and their volunteers or employees may have violated A.R.S. § 16-182,” Courchaine wrote in both letters, according to the Arizona Daily Independent. That state law bars knowingly causing or procuring the registration of a person who is not entitled to vote, the outlet reported.

In the letter to Fontes, Courchaine asked for a review of registrations submitted by the groups “to ensure only United States Citizens were registered to vote,” according to the Arizona Daily Independent. He made a similar request of Heap’s office for Maricopa County, the outlet reported.

A Reminder Before Tuesday

“On the eve of an important midterm election, the District of Arizona reminds the public that voting is limited solely to U.S. citizens,” Courchaine’s office said, adding that this applies even to noncitizens with “legal authority to be in the country on a visa or as a legal permanent resident,” according to Just The News. The office also warned that “knowingly causing another person to be registered to vote while knowing that person is not entitled to do so” violates federal law, Just The News reported.

“If you are not a U.S. citizen, you may not vote in Tuesday’s election,” the office said in its post on X.

What the Groups Say

AZFamily reported that Stand Indivisible Arizona describes itself as a nonpartisan, volunteer-driven nonprofit based in Scottsdale, that Worker Power calls itself a social welfare organization focused on working families, and that When We Count is the only one of the three aligned with a party, describing itself as a Democratic group. Meridian reported that a Democratic National Committee spokesperson called the allegations “fabricated” and “inspired by right-wing operatives.”

The allegations appear to trace to an Oct. 22 undercover video from the conservative outlet Muckraker, according to Meridian, which reported that the video shows a man posing as a noncitizen or felon asking about registering. Meridian reported that the video does not show anyone actually being registered.

The Justice Department has not announced charges against any organization or individual, and it has not said how many registrations may be involved, according to the Arizona Daily Independent. The investigation remains open.

For voters who have watched Washington argue for years over whether noncitizen registration is a real problem, Arizona now has a federal prosecutor saying it is worth the FBI’s time to find out.
