The man charged in the killing of Charlie Kirk still has no trial date. After a pretrial conference in Provo, Utah, that ran roughly three hours Friday, 4th District Judge Tony Graf said he needed more time and would issue his ruling on the schedule at a hearing on Nov. 9, according to the Deseret News and Fox 13 Salt Lake City.
Tyler Robinson, 23, is charged with aggravated murder and six other counts in the Sept. 10, 2025, shooting of Kirk at Utah Valley University, the Deseret News reported. He has pleaded not guilty to all seven counts and faces a possible death sentence if convicted, according to KSL.com.

Fox News Digital reporter Michael Ruiz, who was in the courtroom, said in a post on X that no trial date was set and that Graf scheduled another hearing for Nov. 9 “where we expect a ruling.”
Judge says he won’t rush the decision
Graf had planned to rule Friday, Fox 13 reported, but the lengthy arguments over how long each side needs to prepare led him to hold off. “I am not going to run back into my office and type quickly and kick something out,” Graf said, according to the Deseret News.
The judge called the case a priority and said he is “concerned” about protecting Robinson’s right to a speedy trial, the Deseret News reported. “I will always be concerned about Mr. Robinson’s constitutional rights,” Graf said, according to the paper. He asked both sides to send him written lists of their upcoming trial commitments so he can find dates when all attorneys are available.
Fox 13 noted that a trial date will not necessarily be set on Nov. 9 either.
A gap of nearly two years between the two sides
The defense and prosecution are far apart. Robinson’s attorneys asked for a trial in the third quarter of 2029, saying a capital case requires “extensive and time-consuming” record gathering, interviews with Robinson’s family and friends, and a review of a large body of evidence, according to the Deseret News. Defense attorney Staci Visser told the court that setting a date now is “premature,” the paper reported. “The reality is rushing to trial does not lead to closure,” Visser said, according to the Deseret News. “It does not lead to finality. It leads to mistakes.”
The Utah County Attorney’s Office proposed starting the trial on Jan. 31, 2028, and estimated it would last about 17 weeks, KSL.com reported. The defense has estimated a trial lasting seven months, according to KSL.com.
Kirk family presses for a speedy trial
An attorney for Erika Kirk, Charlie Kirk’s widow, has asked for the trial to begin in October 2027, according to ABC4 Utah. In that filing, the family’s lawyer argued that every day of delay carries “the weight of all that Charlie’s murder has taken from his family,” ABC4 reported.
At the end of Friday’s hearing, Kirk family attorney Jeffrey Nieman asked whether Graf could issue his ruling before the parties return next month, Fox 13 reported. It is unclear whether the judge will grant that request, the station said.
President Trump also weighed in on the judge’s handling of the case earlier Friday, according to ABC4 and Fox 13. Supporters of Kirk voiced frustration online after the hearing; Blake Neff wrote on X that it has been “14 months after Charlie’s murder just to set a trial date.”
The next hearing is set for Nov. 9 at 1 p.m., according to Fox 13.
